Little Dreams Free Learning Space Terms of Service
(“Little Dreams Free Learning Space” – hereinafter referred to as “the Organisation”)
1.1 These Terms of Service (“Terms”) govern the relationship between the Organisation and any person or entity who accesses, uses or accepts the services of the Organisation, including but not limited to students, parents/guardians, volunteer tutors, donors and website users (“you” or “your”).
1.2 By applying for, accepting or using any service provided by the Organisation, you agree to be bound by these Terms, the Organisation’s Constitution, and any policies or codes of conduct issued from time to time.
1.3 The Organisation is a charitable organisation registered in Hong Kong. All services are provided on a non-profit basis.
2.1 Free tutoring services are provided to persons who meet the following criteria:
(a) currently studying at a recognised educational institution in Hong Kong (primary school, secondary school or tertiary institution);
(b) facing genuine financial hardship; and
(c) have submitted a completed application form and any required supporting documents.
2.2 The Organisation reserves full and absolute discretion to accept or reject any application without giving any reason.
2.3 The provision of tutoring services is conditional upon the student’s continued compliance with these Terms and any code of conduct. If the student or guardian engages in conduct that causes disruption, dishonesty or harm to the Organisation or its volunteers, the Organisation may immediately suspend or terminate services.
3.1 The student and his/her parent/guardian (if the student is a minor) agree to:
(a) provide true, accurate and complete information during the application process;
(b) immediately notify the Organisation of any change in financial circumstances or school attended;
(c) attend scheduled tutoring sessions punctually and give at least 24 hours’ notice of cancellation;
(d) respect all volunteer tutors and representatives of the Organisation, and not engage in any form of harassment, discrimination or abusive behaviour;
(e) use the Organisation’s services solely for educational purposes;
(f) not sell, transfer or assign any tutoring sessions or teaching materials provided by the Organisation;
(g) provide proof of receipt of the Hong Kong Comprehensive Social Security Assistance (CSSA) or any successor government cash assistance scheme (“Government Cash Assistance”) as a condition of eligibility for free tutoring services. Such proof must be valid, legible and submitted together with the application form;
(h) give written consent for the Organisation to directly verify the authenticity of the provided CSSA proof with the Social Welfare Department (or any relevant government department). The Organisation may refuse to approve or may terminate any service before verification is completed.
3.2 Any applicant who knowingly provides misleading, false or forged government assistance proof, or conceals material information, shall immediately lose eligibility to receive any services. The Organisation reserves the right to report such conduct, together with all relevant evidence and the applicant’s identifying information, to the Hong Kong Police Force, the Independent Commission Against Corruption, or any other relevant law enforcement department for further investigation and possible legal action.
3.3 The Organisation shall not be liable for any academic performance or results. Tutoring services are provided as support only and do not guarantee improvement in grades or examination performance.
4.1 Volunteers providing tutoring services must:
(a) be at least 18 years of age and become a member (individual member) of the Organisation;
(b) meet one of the following academic requirements:
(i) have obtained a Bachelor’s degree or higher through formal study at a recognised university (honorary degrees are not considered degrees obtained through formal study), and consent to the Organisation verifying their academic qualifications with their graduated institution(s); or
(ii) be currently a student of a recognised university in Hong Kong, hold valid candidature, provide their student card as proof, and consent to the Organisation verifying their student status with the relevant university;
(c) complete any required training, background checks or declarations;
(d) in certain circumstances, the Organisation may request volunteer tutor applicants to consent to undergo a criminal record check arranged by the Organisation before or during their appointment. Those who refuse to give such consent shall entitle the Organisation to refuse appointment or immediately terminate their volunteer position;
(e) comply with the Organisation’s teaching guidelines and code of conduct;
(f) keep all student information confidential;
(g) promptly report any child protection or ethical concerns to the Organisation.
4.2 The Organisation may at any time, without giving any reason, refuse to appoint, suspend or terminate a volunteer’s duties if the Organisation believes that the volunteer’s continued service may pose a risk to students, the Organisation or its reputation.
4.3 Volunteers provide services on a voluntary basis and there is no employment, agency or partnership relationship with the Organisation. Volunteers are not entitled to any wages, benefits or remuneration.
5.1 Donations of HKD 100 or more may be eligible for tax deduction under Hong Kong law. The Organisation will issue an official receipt upon request.
5.2 Donors must provide accurate name and contact information for the issuance of receipts. The Organisation shall not be liable for any incorrect information provided.
5.3 Donations are non-refundable once made, except as otherwise required by law.
5.4 The Organisation shall use donations solely for the charitable purposes set out in its Constitution (Article 1). No donation shall be used for the private benefit of any board member or governing person.
6.1 The Organisation’s website and online platforms are provided on an “as is” and “as available” basis.
6.2 You may adjust font size, background colour, brightness and contrast as needed.
6.3 You shall not:
(a) attempt to gain unauthorised access to any part of the website or systems;
(b) use the website to transmit any viruses, malware or harmful code;
(c) scrape, copy or redistribute any content without permission.
6.4 The Organisation shall not be liable for any temporary unavailability, technical errors or data loss arising from the use of its online platforms.
7.1 To the fullest extent permitted by Hong Kong law:
(a) the Organisation and its officers, board members, volunteers and employees shall not be liable for any direct, indirect, incidental or consequential loss or damage arising out of or in connection with the use of its services, website or materials;
(b) in particular, the Organisation shall not be responsible for any injury, loss or damage occurring during tutoring sessions held in public places, community centres or online, unless such injury, loss or damage is caused by the Organisation’s gross negligence or wilful misconduct.
7.2 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence or fraudulent acts.
To the fullest extent permitted by law, Little Dreams Free Learning Space disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Little Dreams Free Learning Space does not warrant that: (a) the Website will be uninterrupted, secure, or error-free; (b) any defects will be corrected; (c) the Website or the server that makes it available is free of viruses or other harmful components; or (d) the information on the Website is accurate, complete, current, or reliable.
You agree to indemnify and hold harmless the Organisation, its board members, volunteers and agents from and against any and all claims, liabilities, damages, losses and expenses (including legal fees) arising out of or in connection with:
(a) your breach of these Terms;
(b) your misuse of the Organisation’s services;
(c) any act or omission of yours that causes harm to a third party.
9.1 The Organisation collects and processes personal data (e.g., name, contact details, academic information, Comprehensive Social Security Assistance records) for service provision, communication, administration and protection purposes. Except as required by law or with your express consent, the Organisation will not sell or share data with third parties.
9.2 By using the Organisation’s services, you agree that the Organisation may retain records of your participation, attendance and academic progress for internal evaluation and reporting to funders (anonymised where possible).
9.3 You have the right to request access to and correction of your personal data by contacting the Organisation in writing.
10.1 No person interacting with the Organisation shall engage in:
(a) violence, threats, intimidation or harassment;
(b) fraud, misrepresentation or misuse of the Organisation’s funds or property;
(c) any activity that may harm the reputation of the Organisation.
10.2 If the Organisation reasonably believes that a breach of these Terms has occurred, it may immediately suspend or terminate any service, membership or volunteer position without prior notice.
10.3 Upon termination, the affected person must cease using all resources of the Organisation and return any property belonging to the Organisation.
The Organisation reserves the right to update or modify these Terms at any time. The latest version will be published on the Organisation’s website or made available upon request. Continued use of the services after changes constitutes your acceptance of the amended Terms.
12.1 These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
12.2 Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good faith negotiations. If not resolved, the dispute shall be submitted to the exclusive jurisdiction of the Hong Kong courts.
